1. Who we are and how to reach us

This website is operated by AIphinx LLC ("AIPHINX", "we", "us"), a limited liability company organised under the laws of the State of New Mexico, United States, New Mexico Secretary of State entity ID 0008127625, with its principal place of business at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States. 2. Agreeing to these terms

By using this site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. If you use the site on behalf of an organisation, you confirm that you are authorised to accept these terms for it.

3. What this site is for

The site describes the services AIPHINX offers and gives you a way to contact us. Everything on it is general information about how we work. It is not professional, legal, financial, regulatory or technical advice for your particular situation, and you should not rely on it as such. Descriptions of engagement types, timelines and phases are illustrative. The scope, timeline and price of any work are set out only in a written proposal or agreement.

Nothing on this site is an offer capable of acceptance. A contract for services exists only when both parties have signed a written agreement.

4. Enquiries and proposals

When you send an enquiry through the contact form or by email:

• You agree to provide accurate contact details so that we can reply.
• You agree not to include confidential information belonging to a third party that you are not entitled to share, and not to include sensitive personal data unless it is genuinely necessary.
• We aim to reply within one business day, but this is a target, not a commitment.
• We may decline an enquiry, or decline to make a proposal, at our discretion and without giving a reason.
• Anything we send in reply, including indicative scopes or estimates, is non-binding until it is incorporated into a signed agreement.

We treat the contents of enquiries as confidential and use them only as described in the Privacy Policy. If you need a non-disclosure agreement in place before sharing details, say so in your message and we will arrange one first.

5. Acceptable use

You may use this site for its intended purpose: reading about our services and contacting us. You must not:

• Send enquiries that are false, misleading, abusive, or unsolicited commercial messages.
• Submit the contact form automatically, in bulk, or in a way designed to bypass our spam and rate-limiting measures.
• Attempt to gain unauthorised access to any part of the site, including the enquiry dashboard, the enquiry database, or the servers that host them.
• Probe, scan or test the site for vulnerabilities without our prior written permission. If you believe you have found a security issue, email us and we will engage constructively.
• Introduce malware, or interfere with the site's operation or with other users' access to it.
• Copy the site in bulk, frame it, or mirror it, other than the caching your browser or a search engine performs in the ordinary way.
• Use the site in any way that breaks applicable law.

We may block traffic, remove content, or take other reasonable steps to protect the site and its users if we believe these terms have been breached. Where a breach is also a criminal offence we may report it to the relevant authorities.

6. Intellectual property

The AIPHINX name, the AIPHINX mark, and the text, design, graphics and code on this site are owned by AIPHINX or its licensors and are protected by copyright, trade mark and other intellectual property laws. All rights are reserved.

You may view the site, print or download extracts for your own reference, and share links to it. You may not otherwise reproduce, adapt, distribute or commercially exploit any part of it without our written permission. You may not use the AIPHINX name or mark in a way that suggests endorsement or affiliation.

The typefaces used on the site are licensed from their respective owners and are not licensed to you through this site.

7. Privacy

Our Privacy Policy explains what personal data we collect through this site, why, how long we keep it, and your rights. It forms part of these terms. In short: we collect what you type into the contact form plus basic technical data needed to keep the site secure, we run no analytics or advertising trackers, and the public pages set no cookies.

8. Third-party links and resources

The site may reference or link to third-party websites, standards and frameworks, such as the EU AI Act, ISO/IEC 42001 or the NIST AI Risk Management Framework. These references are for information. We do not control third-party sites and are not responsible for their content or their handling of your data. A link is not an endorsement.

9. Availability and changes to the site

We try to keep the site available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components. We may change, suspend or withdraw any part of the site at any time without notice. Content may be out of date at any given moment, and we are under no obligation to update it.

10. Disclaimers and limitation of liability

The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all conditions, warranties and representations, express or implied, in relation to the site and its content, including any implied warranties of accuracy, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, AIPHINX will not be liable to you for any loss or damage arising from your use of, or inability to use, the site or its content, or from reliance on any information on it. This includes loss of profit, business, revenue, data or goodwill, and any indirect or consequential loss, whether the claim is in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were advised that such loss was possible.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law. If you are a consumer, nothing in these terms affects your statutory rights.

Liability arising under a consulting or services engagement is governed solely by the agreement for that engagement.

11. General

• Entire agreement for the site. These terms and the Privacy Policy are the whole agreement between you and us about your use of the site. They do not replace any separate agreement about services.
• Severability. If a court finds any part of these terms unenforceable, the rest continues to apply.
• No waiver. If we do not enforce a right under these terms, that is not a waiver of it.
• Assignment. We may transfer our rights and obligations under these terms to a successor business. You may not transfer yours without our written consent.
• Third parties. No one other than you and us has any rights under these terms.
• Language. These terms are written in English. Any translation is for convenience only.

12. Governing law

These terms, and any dispute or claim arising out of or in connection with them or with your use of the site, are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules. The state and federal courts located in Bernalillo County, New Mexico have exclusive jurisdiction to settle any such dispute, except that if you are a consumer you may also bring proceedings in the courts of the country where you live, and you keep any protection given to you by the mandatory law of that country.

13. Changes to these terms

We may revise these terms from time to time. The effective date at the top shows the current version. Changes apply from the moment they are published on this page, and continuing to use the site after that means you accept them. Please check back occasionally.
